Article 1 – Definitions
In these terms and conditions, the following definitions apply:
- Webshop: 50cc Parts (Chamber of Commerce number 98948423), owner of this website
- Customer: the natural person who enters into an agreement with the webshop.
- Agreement: any order of products placed via the webshop.
Article 2 – Applicability
- These general terms and conditions apply to all offers, orders and agreements between the webshop and the customer.
- Deviations from these terms and conditions are only valid if expressly agreed upon in writing.
Article 3 – Offers and prices
- All prices displayed on the website are in euros and include VAT, unless stated otherwise.
- The webshop reserves the right to correct errors in prices or product information.
Article 4 – Orders and formation of the agreement
- The customer may place orders via the webshop.
- The agreement is concluded at the moment the webshop has received and confirmed the customer’s order.
Article 5 – Payment
- Payment may be made using the payment methods offered in the webshop.
- Payment must be made in advance, unless stated otherwise.
Article 6 – Delivery and shipping
- Our webshop delivers products within the Netherlands and, where possible, internationally.
- Any delivery times stated are indicative only and do not constitute a binding delivery period. We aim to deliver products as quickly as possible.
- The risk of loss or damage to the products transfers to the customer at the moment the products are delivered to the customer. The customer is expected to inspect the products upon receipt and must report any damage or defects immediately.
Article 7 – Right of withdrawal (14 days)
- Consumers have the right to withdraw from the agreement within fourteen (14) days (statutory right of withdrawal).
- The withdrawal period starts on the day the customer receives the product.
- The product must be returned unused and in its original condition, insofar as reasonably possible. The customer may only handle and inspect the product as would be permitted in a physical retail store. For further information, we refer to our return policy on the website.
- The costs of returning the product are borne by the customer, unless stated otherwise.
- After receipt of the returned product, we will refund the original purchase amount, excluding shipping costs, within fourteen (14) days using the same payment method used for the original transaction.
- The right of withdrawal does not apply to specially ordered or custom-made products, or to products that can no longer be sold as new due to installation, use or damage.
Article 8 – Complaints and warranty
- The customer is obliged to inspect the delivered product immediately upon receipt for visible defects, damage or deviations. Any complaints regarding such issues must be reported to 50cc Parts in writing or by e-mail as soon as possible, but no later than seven (7) days after receipt of the product.
- Complaints regarding non-visible defects that become apparent only after use must be reported to 50cc Parts within a reasonable period after discovery.
- If a complaint is found to be justified, 50cc Parts will, at its own discretion, repair or replace the product or refund (part of) the purchase price.
- 50cc Parts provides a warranty of one (1) year on its products, unless explicitly stated otherwise.
- The warranty shall lapse if: • the product has been used incorrectly or improperly; • the product has been installed, modified or repaired by the customer or by third parties; • the product has been used contrary to the operating or installation instructions; • the product has been used for purposes other than those for which it is intended, including use on public roads of products intended exclusively for racing or track use; • normal wear and tear is involved.
- The warranty covers manufacturing and material defects only and explicitly excludes damage caused by installation, adjustment, use or combination with other (tuning) parts.
- The warranty provided by 50cc Parts does not affect the statutory rights of the consumer arising from conformity as laid down in the Dutch Civil Code.
Article 9 – Privacy and personal data
- Personal data of the customer are processed in accordance with the webshop’s privacy policy.
- Data are used solely for the performance of the agreement and for legally required purposes.
Article 10 – Use of products / liability
- 50cc Parts shall not be liable for indirect damage, consequential damage, business damage, loss of profit or any other form of indirect damage, unless such damage is caused by intent or gross negligence on the part of 50cc Parts.
- The liability of 50cc Parts shall, to the extent permitted by law, be limited to the amount paid by the customer for the relevant product.
- The limitations of liability set out in this article do not apply if and insofar as the damage is the result of intent or gross negligence of 50cc Parts, nor in the event of personal injury or liability arising from mandatory provisions regarding product liability.
- Some of the products offered by 50cc Parts are intended exclusively for racing, track and/or sporting use and are not approved for use on public roads.
- These products may affect the power and/or maximum speed of the vehicle and may not comply with legal requirements for use on public roads. The customer is solely responsible at all times for the correct, legal and safe use of the vehicle and for compliance with all applicable laws and regulations.
- Use of the delivered products is entirely at the customer’s own risk. 50cc Parts accepts no liability for damage, fines, seizure, rejection during inspections or any other consequences resulting from incorrect, unlawful or prohibited use of the products.
- Installation, adjustment and maintenance of the delivered products are entirely at the customer’s expense and risk. 50cc Parts shall not be liable for damage caused by incorrect or improper installation or adjustment, regardless of whether such work is carried out by the customer or by third parties.
- Liability of 50cc Parts is excluded if products are used in combination with non-original parts, tuning parts or in a modified vehicle configuration.
- Any installation instructions, product specifications and other information are provided for general information purposes only. No rights may be derived from such information.
- The customer fully indemnifies 50cc Parts against all third-party claims arising from the use of the delivered products, including claims for damage caused by incorrect use, installation or combination with other parts.
- 50cc Parts advises that installation and adjustment of the delivered products be carried out by a qualified or professional mechanic. Compliance with this advice is entirely the responsibility of the customer.
Article 11 – Governing law and disputes
- All agreements are governed by Dutch law.
- Disputes shall preferably be resolved by mutual consultation. If this is not possible, the dispute shall be submitted to the competent court in the Netherlands.
Article 12 – Amendment and availability of the terms and conditions
- These general terms and conditions have been filed with the Chamber of Commerce under number 98948423.
- These terms and conditions can also be consulted on our website: www.50ccparts.nl. The most recent version of the terms and conditions applies to each agreement, or the version applicable at the time the agreement was concluded.
